- SCOPE OF APPLICATION
For all orders placed through our online shop, the following terms and conditions apply. These are available in their current version on our website https://zazzowear.com/ under the section ‘Terms and Conditions’
- CONTRACTING PARTIES, CONCLUSION OF CONTRACT, Correction Options
The purchase contract is concluded with SMART DG LTD.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the ordering process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart. The confirmation of receipt of your order is sent immediately by email after you have placed the order.
We accept your offer within two days by
- sending a separate email declaring acceptance, or
- processing the payment transaction through our service provider or the selected payment service provider, if applicable. The timing of the payment transaction depends on the chosen payment method (see ‘Payment’).
The relevant alternative for you depends on which of the listed events occurs first.
- LANGUAGE OF CONTRACT, CONTRACT TEXT STORAGE
The language available for the conclusion of the contract is English. We store the contract text and send you the order data and our terms and conditions in text form.
4. DELIVERY
(1) In addition to the indicated product prices, shipping costs will be added. For details on the amount of shipping costs, please refer to the offers and our shipping information under Shipping Costs.
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
(2) We deliver available goods within Europe within 3 to 5 working days by postal service. For shipments outside Europe, delivery of available goods takes 10 to 14 working days. For shipments to countries outside Europe, the delivery time depends on the shipping method (airmail/land route/shipping) and the recipient’s location.
(3) If an item is exceptionally not available or cannot be delivered as quickly, we will inform you of the delivery date as soon as possible, or alternatively, that delivery cannot be made. We reserve the right to make partial deliveries if this appears advantageous for expedited processing and is reasonable for you. Your statutory warranty rights are not limited or excluded by partial deliveries. If partial deliveries are made, we will naturally bear the additional shipping costs. There will be no additional costs for you.
(4) If, without our fault, we are unable to deliver the goods you ordered because our supplier does not fulfill its contractual obligations, we expressly reserve the right to withdraw from the contract. In this case, we undertake to inform you immediately about the non-availability of the goods and to refund any payments you have already made promptly.
(5) If deadlines are not met due to force majeure, such as mobilization, war, riots, or similar events such as strikes or lockouts, the deadlines shall be extended appropriately.
- REVOCATION INSTRUCTION
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods if you return them from abroad. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

- PRICES
The prices applicable are those listed in the current catalog at the time of the conclusion of the contract or the prices published on our website https://zazzowear.com/ at the time of the conclusion of the contract.
- POSTAGE AND SHIPPING COSTS
Shipping is handled by Sameday for Bulgaria. DPD, DHL, Hermes, FedEx, Ups and any available high rated shipping companies for rest of the world.
(1) For orders within Europe, we offer free shipping for orders over €120. For orders below €120, we charge a flat rate shipping fee of €4.95 for postage and packaging.
(2) Shipping costs and return shipping costs for international deliveries are the responsibility of the buyer. When importing into a non-EU country, customs duties and taxes usually apply. Proper customs clearance of the goods is the responsibility of the buyer; please inquire about the customs duties and taxes levied in your country before placing an order.
- PAYMENT TERMS
In our shop, the following payment methods are available:
Cash on Delivery
You pay the purchase price directly to the delivery person. There are no additional costs for this option.
Credit Card Payment (Coming Soon)
Soon, we will accept card payments on Zazzowear.com. Currently, we accept American Express, Mastercard, and Visa Card. Refunds due to returns will be credited to your credit card account.
The integrated SSL procedure ensures the security of data transmission for credit card payments.
If your credit card provider participates in the 3D Secure process (security procedure and authentication of your credit card), you may be asked to enter your PIN at the end of your order. If you have any questions about registering for the 3D Secure process, please contact your credit card provider directly.
Due to an EU directive, we are obligated to carry out a 2-factor authentication for credit card payments.
The EU directive PSD2 states that for online payments in the future, you may be asked to confirm your identity with 2 factors in a separate step.
If you have not already done so, please contact your bank and inquire about the authentication methods offered there. This could be a code sent via SMS or email, or a fingerprint in a banking app. Once the process is underway, card payments will be even more secure.
For customers who do not use a smartphone, there are alternative identification methods, such as a TAN generator or PIN sent via SMS.
The systems offered depend on the respective credit institutions.
- RETENTION OF TITLE
The goods remain our property until full payment has been made.
- TRANSPORTATION AND TRANSPORT DAMAGE
We deliver with high rated courier companies only. Please inspect the goods for damages upon receipt. If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us immediately will have no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
- WARRANTY AND GUARANTEES
Unless otherwise expressly agreed below, the statutory warranty rights shall apply. The limitation period for warranty claims for used items is one year from the delivery of the goods. The above limitations and reductions in the statute of limitations do not apply to claims for damages caused by us, our legal representatives, or agents.
-in case of injury to life, body, or health,
-in case of intentional or grossly negligent breach of duty as well as deceit,
-in case of breach of material contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on which the contractual partner regularly relies (cardinal obligations),
-within the scope of a guarantee promise, if agreed, or
-to the extent that the scope of the Product Liability Act is opened up.

- LIABILITY
For claims arising from damages caused by us, our legal representatives, or agents, we shall always be liable without limitation.
– in case of injury to life, body, or health,
– in case of intentional or grossly negligent breach of duty,
– in case of warranty promises, if agreed, or
– to the extent the scope of the Product Liability Act applies.
In case of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on which the contracting party can regularly rely (cardinal obligations), the liability for slight negligence on our part, our legal representatives, or vicarious agents is limited to the foreseeable damage typical for such contracts at the time of contract conclusion, to the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
- DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/.
We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board. The competent authority is the London Arbitration Centre located at 62 Tunstall Drive, Accrington, Lancashire BB5 5DG, United Kingdom. - DATA STORAGE
(1) We store, process, and use the personal data provided by you on the order form to fulfill your order. Some of this data is shared with the transport companies we have commissioned to process the order (e.g., delivery and package notification).
(2) Upon written request, you will receive from us free of charge a statement of the data stored about you. Incorrectly stored data will be corrected upon your written request. If you have given us consent to use your personal data for a purpose not already permitted by law, you can revoke this consent at any time.
- APPLICABLE LAW AND JURISDICTION
(1) These terms and conditions, as well as all contracts concluded in accordance with these terms and the disputes arising therefrom, are subject to United Kingdom law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) We endeavor to resolve any differences of opinion quickly and without bureaucracy. For all disputes arising out of or in connection with these terms and conditions as well as individual contracts, London is the exclusive place of jurisdiction if, at the time of filing the lawsuit, your domicile or habitual residence is either not located within the country or is unknown.
